1. Acceptance of Terms

By accessing or using DMAI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

DMAI is an AI content generation platform that allows users to create images, videos, and AI characters using various artificial intelligence models. The Service includes image generation, video generation, character creation, image upscaling, and a media gallery.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Token System and Payments

The Service operates on a token-based system. Tokens are consumed when generating content. Free accounts receive a limited number of tokens per month. Additional tokens can be purchased through subscription plans or one-time top-ups. Token purchases are non-refundable except where required by applicable law.

5. Content Ownership

You retain ownership of content you generate using the Service, subject to the terms of the underlying AI models. You are responsible for ensuring your use of generated content complies with applicable laws and regulations. DMAI does not claim ownership of your generated content.

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, or violates the rights of others
• Create deepfakes or non-consensual intimate imagery of real people
• Generate content depicting the exploitation of minors
• Circumvent usage limits or abuse the token system
• Reverse engineer or attempt to extract the underlying AI models
• Use the Service for any purpose that violates applicable laws

7. Limitation of Liability

The Service is provided “as is” without warranties of any kind. DMAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
